Senators Santorum and Piccola Miss the Boat

Pennsylvania Senator Rick Santorum has expressed a strong view on medical malpractice lawsuits. In July of 1999, Santorum voted against a bill that would have given patients the right to sue health maintenance organizations for malpractice, the same bill nicknamed "the patients Bill of Rights." Santorum has always been a strong public figure against "frivolous lawsuits." In fact, he was quoted saying this:

"While we may have people, individuals, who hit the jackpot and win the lottery in some cases, that is not exactly what our legal system should be designed to do."

Santorum introduced House Bill 3918, which puts a $250,000 cap on all medical malpractice lawsuits.

However, according to new reports, in 1999, Santorum's wife sued for medical malpractice when a spinal manipulation resulted in a herniated disc. She sued for $500,000 and the jury settled at $300,000. Senator Santorum says he supports his wife's decision to go to court.

We at Dale E. Anstine believe that if you have been unfairly injured, and have received improper care by a health center, you are entitled to sue and collect damages for your pain and suffering. Unlike the Senator, our attorneys and staff support everybody's right to go to court, not just Senator Santorum’s wife.

We believe you should receive the full value of your damages, not an arbitrary cap designed to benefit the insurance industry. Senator Santorum and others, such as State Senator Piccola, need to remember that they represent all citizens, not just special business interests such as the insurance industry.
